Federal Lawsuit Filed On E-Cigarette Flavors Ban A federal lawsuit was filed Friday against the state for the emergency rules issued by the Department of Health and Human Services banning nearly all flavors for e-cigarettes. This case, having been filed in federal court, however, makes claims of how the rules violate federal law. It asserts they violate the Commerce Clause of the U.S. Constitution that says only Congress can regulate interstate commerce and the Supremacy Clause of the Constitution.
Basically, the suit argues that this does not fall under the jurisdiction of the state and that this is a federal issue. Furthermore, it argues that the state is infringing on our constitutional rights.
What do you guys think? Is it a positive thing that the state is doing because it is regarding the health of human beings... or has the state of Michigan gone too far?
